Does Oregon Have A Medical Malpractice Cap?

When we admit ourselves to a hospital or are seen by a healthcare professional, we expect to leave in a better condition rather than a worsening one caused by negligence. When an injured patient files a medical malpractice claim, if successful, he or she can recover economic and non-economic damages. Non-economic damages, which include pain and suffering and loss of consortium, are limited to $500,000 per plaintiff.

That said, there are no damage caps on economic damages, which include present and future costs of medical treatment, lost wages, and loss of work. Additionally, if punitive damages apply to your case, there is no cap for this either. Punitive damages are only permitted against hospitals and are not applicable in cases against healthcare providers.
